Entrepreneurs of the IT industry are appealing to the Antimonopoly Committee to take measures with regard to Kyivzhytlospetsekspluatatsiya, which has occupied the telecommunication market of the capital city, violated the rights of citizens and businesses, and used its position for its own enrichment to drive possible competitors out of business. In particular, they are calling for the speeding up consideration of cases on abuses committed by the monopoly company and the Kyiv City Administration that has been encouraging such a situation. This is stated in a joint resolution of specialized operators and providers adopted by the ULIE at a round table talk devoted to "Problems of installing telecommunications equipment on buildings in communal ownership, strengthening of the monopoly position and pressure by utility company Kyivzhytlospetsekspluatatsiya on the telecommunication market".
The document emphasizes that the advantageous position of the mentioned utility company has been favored by Kyiv City Administration, which for several years has been adopting unlawful decisions to expand the powers of Kyivzhytlospetsekspluatatsiya. In accordance with these decisions, Kyivzhytlospetsekspluatatsiya has received exclusive rights to conclude contracts on installing telecommunication networks in buildings in communal ownership, as well as grant specifications and approvals to other market participants. Moreover, it has been authorized to dismantle the telecommunication networks and equipment already installed, which it has been actively engaged in.
Representatives of the telecommunications sector demand that the city council cancels the "indulgences" it has issued, stop encouraging exertion of pressure on business, and provide all conditions for equal competition between market participants and the freedom to independently select service providers by the consumers. To this end, they called on the public to support their demands and encourage the authorities to adopt a draft law "On access to infrastructure of construction facilities, transportation, power supply for the development of telecommunication networks," that has been prepared by the National Commission for the State Regulation of Communications and Informatization.
The IT business community is confident that the settlement of this issue at the legislative level will prevent violations of law in the future, guarantee the constitutional rights of citizens and entrepreneurs, and create conditions for equal competition, which will have a positive impact not only on the industry, but also on the Ukrainian economy and its investment attractiveness.
