The issue of crossing the state border by military conscripts employed by enterprises for the purpose of fulfilling foreign economic agreements (contracts) and participating in international exhibitions remains highly relevant.
Currently, the Rules for Crossing the State Border by Ukrainian Citizens, approved by the resolution of the Cabinet of Ministers of Ukraine dated January 27, 1995, No. 57 (as amended), are in effect.
This mechanism for approving business trips requires improvement.
Therefore, in response to numerous appeals from the Ukrainian Union of Industrialists and Entrepreneurs and the Anti-Crisis Staff for Economic Stability in Times of Martial Law, the Plan of Priority Actions of the Government for 2023 included an order for the Ministry of Internal Affairs (MIA), in conjunction with the Ministry of Defense and the State Border Guard Administration, to develop and submit to the Cabinet of Ministers a draft law to improve legislation on border control.
ULIE has sent a letter to the Head of the MIA of Ukraine, Igor Klymenko, urging the acceleration of this process.
"Understanding the priority of implementing mobilization tasks of the Ministry of Defense, we also believe that preserving the export prospects of Ukrainian manufacturers is an essential contribution to victory over the Russian aggressor," the business union stated.
The joint position of the business community and the Ministry of Economy, which has already provided its proposals for the future legislative act, includes the following points:
- The possibility of business trips for conscripts reserved for the period of mobilization and during wartime by enterprises, institutions, and organizations in accordance with the procedures established by the Cabinet of Ministers of Ukraine.
- Crossing the state border is carried out for the purpose of a business trip for a period not exceeding 30 calendar days (with the appropriate documentation approved).
- Execution of foreign economic agreements (contracts) by the enterprise and participation in international exhibitions (with corresponding confirmation - the presence of a foreign economic (contract) agreement, an invitation to the exhibition event).
